(AMENDMENT) ACT, 1997
An Act further to amend
the General Clauses Act, 1897

(Parliament) received the assent of the President on the 31st May, 1997, is
hereby published for general information:‑‑
Whereas it is expedient to amend the General Clauses Act, 1897 (X of 1897), for
the purpose hereinafter appearing;
It is hereby enacted as follows:‑‑
1. Short title and commencement.‑‑(1)
This Act may be called the General Clauses (Amendment) Act, 1997.
(2) It shall come into force at once.
2. Insertion of a new section 24A, Act X of 1897.‑‑‑In
the General Clauses Act, 1897 (Act X of 1897), after section 24, the following
new section shall be inserted, namely:‑‑
"24A. Exercise of power under enactments. ‑‑(1) Where, by or
under any enactment, a power to make any order or give any direction is
conferred on any authority, office or person such power shall be exercised
reasonably, fairly, justly and for the advancement of the purposes of the enactment.
(2) The authority, office or person making any order or issuing any direction
under the powers conferred by or under any enactment shall, so far as necessary
or appropriate, give reasons for malting the order or, as the case may be, for issuing the direction and shall provide a copy
of the order or, as the case may be, the direction to the person affected
prejudicially.".,
